Terms of Service

Welcome to Hoppa (the "App"), a mobile application developed for dance learning, real-time body tracking, and scoring. By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and the developers of Hoppa ("we," "us," or "our"). By accessing or using the App, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy. These Terms supplement and incorporate the standard Apple Licensed Application End User License Agreement (EULA) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that you have reviewed these Terms with your parent or legal guardian and that they agree to these Terms on your behalf. The App is not intended for children under 13.

3. Description of Services

Hoppa provides a Vision-powered body-tracking dance game. Features include:

  • Real-time camera body tracking and joint position matching.
  • In-app scoring, performance history tracking, and global leaderboard rankings.
  • Local video saving and local network streaming options.
  • An AI-powered feature to request custom stick-figure choreographies by converting video links, including links from third-party platforms like YouTube.

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice or liability.

4. Privacy & Data Processing

Your privacy is important to us.

  • On-Device Processing: Camera video feeds and raw body tracking skeleton data are processed locally and in real-time on your device. We do not stream or upload your raw camera feed to our servers.
  • Cloud Storage: We store user profile information, high scores, and performance history (e.g., timestamps and numerical scores) on our cloud servers to enable leaderboards and profile syncing.
  • Video Saving: Saved videos of your performance are stored locally in your device's Photos app.
  • Local Network Streaming: The screen sharing / LAN streaming feature broadcasts video feeds locally on your Wi-Fi network and is not uploaded to our cloud servers.

5. YouTube Integration & Third-Party Services

Hoppa includes a feature that allows users to request custom stick-figure choreographies by pasting YouTube video links (the "YouTube Converter").

  • YouTube Terms of Service: By using the YouTube integration, you acknowledge and agree that you are also bound by the YouTube Terms of Service (available at https://www.youtube.com/t/terms) and the Google Privacy Policy (available at http://www.google.com/policies/privacy). In addition, users can revoke the App's access to their data via the Google Security Settings page at https://security.google.com/settings/security/permissions.
  • Third-Party Content: We do not host, store, or claim ownership over any third-party videos. The converter extracts pose coordinates to generate simplified stick figures.
  • User Responsibility: You are solely responsible for ensuring that the video links you submit do not violate any copyright, trademark, or third-party rights. You agree not to use this feature to process copyrighted content for which you do not have permission.

6. Physical Activity and Safety Disclaimer

  • Physical Exertion: Using the App involves physical movement, dancing, and exercise. You acknowledge that physical activities carry inherent risks of injury.
  • Health and Safety: You represent that you are in good physical condition and have no medical reason or impairment that would prevent you from safely using the App.
  • Safe Environment: You agree to clear your surroundings of any furniture, sharp objects, or obstacles before dancing. Always maintain full awareness of your physical environment to prevent slips, trips, and falls.
  • No Liability: To the maximum extent permitted by law, we shall not be liable for any personal injury, property damage, or health issues arising from your use of the App.

7. Rules of Conduct & Fair Play

You agree not to:

  • Cheat, exploit, or use automated systems/bots to spoof motion data or scores on the leaderboard.
  • Decompile, reverse engineer, or attempt to extract the source code of the App.
  • Upload, submit, or transmit any links or content that are illegal, harmful, threatening, abusive, or infringing.
  • Use the App for any commercial purpose without our prior written consent.

8. Intellectual Property Rights

All rights, title, and interest in and to the App (excluding third-party content like YouTube video sources), including but not limited to the design, UI elements, branding, stick-figure generation algorithms, and proprietary code, are and will remain our exclusive property. Hoppa grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT warrant that the dance tracking will be 100% accurate, uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

11. Governing Law

These Terms and your use of the App shall be governed by and construed in accordance with the laws of the jurisdiction in which the App developer resides, without regard to its conflict of law principles.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page or within the App. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

13. Controlling Language

This agreement is executed in the English language. Any translation of these Terms is provided for convenience only. In the event of any conflict or inconsistency between the English version and any translated version, the English version shall prevail.
